What is Lucky Scarabs?

Under Section 106 of New Zealand’s Gambling Act 2003, a class 4 licence holder, also known as a “corporate society” by the regulator, “must apply or distribute the net proceeds from class 4 gambling only to or for an authorised purpose specified in the corporate society’s licence”.

The DIA worked directly with class 4 gambling operators (commonly known as pokies trusts), and discovered ‘widespread issues’ such as cases where money that should have been available for community grants was instead spent on society expenses, such as the purchase of additional gaming machines.

Vicki Scott, the DIA’s director of gambling, said the investigation had delivered significant results, while stressing that work to improve compliance and ensure communities received their share of gambling proceeds would continue.

In one of his Instagram stories, speaking directly to the camera, Pedro (a fictitious name for a “professional gambler”) shares a “unique opportunity”. He says that he is going to release a “super promotion for a premium group, which has higher odds”.

The normal price for access to the Telegram group would be BRL397 ($77.18) per month. But, exclusively on that day, he would release both groups together for “only BRL14.91 per month on the annual plan”. This group is the main product sold by Pedro, where he publishes sports predictions, tips on betting operators and higher-value betting odds.

The problem is that many of these recommendations involve companies that are not authorised to operate in Brazil. Some may be licensed in other countries, but that doesn’t allow them to operate legally in the Brazilian market.

As such, the ad violated rule 16.3 of the CAP Code (Edition 12).

Midnite’s operator, Dribble Media Ltd, stated that the ad had not been authorised by their company. They cited discrepancies in branding and asserted that it was created and disseminated by an affiliate, Limay Media Ltd, without Midnite’s approval. 

Midnite confirmed it had terminated its contract with Limay and would reinforce compliance reminders to its partners.
